On February 2, 2026, Consumer Voice, along with over 90 other national and state organizations, submitted comments in opposition to the Centers for Medicare & Medicaid’s (CMS) plan to rescind the minimum staffing standard in nursing homes. The comments focused on how CMS’s reasons for rescinding the rule were misplaced and unsupported by evidence. With the rule being rescinded February 2, 2026, the organizations noted that CMS still had a statutory duty to ensure nursing homes have sufficient staff to meet the needs of all nursing home residents, and called on CMS to adopt an evidence based and data driver enforcement strategy.
